Media File Transfer Agreement

This agreement (“Agreement”) is made between the sender of the media file (“Sender”) and the individual receiving the media file (“User”) via SendGB (“Provider”). The User acknowledges that by receiving the media file from SendGB, they have read, understood, and agree to be bound by the following terms and conditions:

Ownership and Copyright: The media file being sent is the property of the Sender or their respective copyright owners, and the User may only use it for personal and non-commercial purposes.

Responsibility: The Sender is not responsible for any consequences resulting from the User’s use or misuse of the media file, including any inability to access or download the media file or any technical issues that may arise.

Refund: The Sender is not liable to provide a refund to the User if they are unable to download or access the media file from SendGB or if the media file is not acting in their favor.

Use of SendGB Only: The User agrees to use SendGB only for the purpose of downloading the media file and acknowledges that any attempt to access the media file from any other source is prohibited.

Exclusive Distribution on SendGB: The User acknowledges that the media file will only be distributed on SendGB and not through any other websites.

Security: The User is responsible for ensuring the security of their device and network while downloading the media file. The Provider will not be responsible for any damages or losses resulting from security breaches or viruses that may infect the User’s device.

No Warranty: The media file is provided “as is” without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability: The Sender and Provider shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from the User’s download or use of the media file, or their inability to access or use SendGB.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Sender resides, without giving effect to any choice of law or conflict of law provisions.

The User acknowledges that they have read, understood, and agree to be bound by this Agreement. This Agreement constitutes the entire agreement between the Sender and the User and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement.

By sending the media file via SendGB, the Sender agrees to be bound by this Agreement.
